However, if you are not ready for change or have significant emotional challenges that affect your ability to make changes, we are willing to help you recognize and accept where you are and may recommend another practitioner to assist you.

Allergies

If you experience an unexpected allergic reaction to a product we have prescribed, please notify us as soon as possible. If you experience life-threatening symptoms, such as anaphylaxis, you must call 000 immediately.

Limitation of Liability

We take our obligations under Australian Consumer Law seriously and will make every effort to address any issues that may arise. However, even in the case of a major problem, our liability is strictly limited to:

  1. Replacing the goods or providing the services again; or

  2. If we are unable to do so within a reasonable time, we will pay the cost of having the relevant goods or services supplied to you again.

Payment Terms

Forms of Payment

All payments made through this website are processed through official payment channels. Payments for consultations are processed through Stripe or Square when booked online. The option to pay via bank transfer for review consultations is available. Direct bank transfer payments for invoices are preferred to avoid fees. We do not have access to your account details. Any financial information you enter is stored under the payment channels’ security policy.

Payment Policy

All payments must be made in full before your scheduled appointment to secure your booking. An invoice will be emailed to you before your session, which can be paid via card or bank transfer (details provided on the invoice). Payments not made before the scheduled appointment will incur a $5 late fee for each day after your appointment that payment is not made. If payment is not received within 90 days, you agree to pay all costs, including debt collection agency fees and solicitor's costs, incurred while seeking to recover any outstanding payments, whether or not legal proceedings are initiated in relation to the debt. Further appointments will not be scheduled if full payment has not been received for the previous consultation. You also understand and agree that your deposit will be retained as a credit to secure your appointment and is non-refundable if the booking is canceled or rescheduled within the 48-hour cancellation window.

Payment Plans

Payment plans are offered for your convenience to spread your payment out over time. You remain committed to paying the entire amount, even if you change your mind about completing additional sessions, as you have had access to our intellectual property. It is your responsibility to ensure you have sufficient funds to make payment installments on time. If a payment is overdue by more than 72 hours, access to booking appointments will be suspended until your payments are up to date. If your payment is more than 7 days overdue and you have not contacted us to make alternative arrangements, the payment plan will be canceled. An invoice for the entire remaining amount will be sent to you, and our standard payment terms will apply to that invoice.

Nutrition Packages

Payments for the package are due before your initial consultation. The follow-up reviews must be scheduled within 12 months of your initial consultation. If you reschedule your appointment and do not rebook within 12 months, your consultation will no longer be valid, and you will need to rebook an Extended Review Consultation. Your health and needs significantly change within a 12-month period, and regular appointments, especially in the initial stages of treatment, are essential for monitoring your progress and ensuring safety. Beyond the 12-month mark, a more in-depth review of your health will be required, necessitating a longer consultation time - refer to the Extended Consultation for details.

Appointment Policies

Online Appointments

All Telehealth appointments are conducted online using the Zoom online meeting platform OR via phone call. You can download Zoom here. If you require assistance installing Zoom, please contact us at klfreeeman@gmail.com. A link to your Zoom meeting will be emailed to you in your appointment reminder email. Please click the link at the time of your appointment. If you are early to the appointment, you will be directed to the waiting room. Once it is time for your appointment to begin, you will be directed to our meeting room where we will commence the consultation. Please ensure you are in a private and quiet space free from distractions and have a strong Wi-Fi connection.

Appointment Cancellation & Rescheduling Policy

We maintain a strict cancellation policy. Cancellation of a consultation, workshop, or event requires 48 hours' notice. Cancellations or failure to attend received within 48 hours of the scheduled consultation or event will incur 100% of the total fee. Any payments made prior to the session will not be refunded if rescheduling or cancellation occurs within 48 hours. If you are unable to attend your appointment, please contact us as soon as possible. If unforeseen circumstances arise, and we are unable to proceed with the appointment, a full refund or rescheduling will be offered, and you will be notified promptly. This policy is in place to maintain consistency in the booking process. As we highly value your time, we appreciate mutual respect for our time and the time of other clients. Failure To Attend Consultation

If you fail to attend a consultation without notice, we will make every effort to contact you via phone call, text message, and email at the time of your scheduled appointment. If you fail to attend your appointment 15 minutes after the scheduled time, the session will be forfeited, and no refund will be provided. You will be offered the opportunity to reschedule your appointment with payment required at the time of booking to secure your appointment.

Intake Forms

An intake form will need to be completed at the time of booking. We kindly request that you complete the form no later than 48 hours before the scheduled consultation. If the intake form is not received prior to the scheduled appointment, it will need to be completed during your appointment. This may result in a loss of consultation time, and the full consultation fee will still be charged. Further consultations may be required to gather any information missed. Providing us with accurate and complete information about your health, including any diagnosed medical conditions, medications or supplements, and known allergies and intolerances, is crucial for your safety during treatment and to check for potential interactions with any herbs or nutrients we may prescribe.

Email Policy

Contact can be made through email or the Power Diary client portal only. Please keep in mind that we cannot provide treatment advice via email, and you may be advised to either wait until your next appointment or reschedule your appointment if your query is more urgent. In cases of emergency when immediate help or counsel is needed, please contact appropriate services such as Emergency (000) or Lifeline (131 411).

Referral Program

If they mention your name in their New Client Health Questionnaire you will also receive 10% off your next appointment. Only one voucher is valid per consultation. If you provide multiple referrals, the voucher will be added to your next consultation.

External Referrals

As a dietetic practice, we are dedicated to enhancing your lifestyle, health, and well-being. However, there are times when the services you need for healing are outside of our scope of practice. In these cases, we will refer you to a suitable practitioner, such as a GP, counselor, psychologist, massage therapist, physiotherapist, or osteopath.

Refund Policy

Nutrition Packages

A full refund of 50% will be given for the New Client Wellness Plan Package if you change your mind about booking an appointment. If cancellation occurs within 48 hours of the initial consultation, no refunds will be issued. Appointments made directly through Vida Verde Health will be sent an invoice via email to be paid within 24 hours to secure the spot. If payment is not received within 24 hours, the appointment time will not be secured, and a rebooking will be required.

Review Consultation Wellness Packages

We understand that nothing is worse than purchasing something you can't use. As a result, we offer a 100% satisfaction guarantee if you change your mind and decide this purchase is not right for you within 14 days of purchase if no sessions have been used. All Wellness Packages are valid for 12 months. Any consultations that are not used within the 12-month period will be forfeited, and a consultation will need to be repurchased at the full price if desired.

Ebooks & Courses

Due to the nature of digital products, there are strictly no refunds for a change of mind. We encourage you to consider carefully whether a purchase with us is right for you before making your payments.

If any product becomes out of stock after you submit your order, you will be notified via email as soon as possible. You will be offered the option of a refund or waitlisted for the producat restock.

Dispute Resolution & Jurisdiction

Negotiation

If you have any concerns, issues, or complaints arising from your use of this website, our products or services, or these terms and conditions, we agree to communicate with the intention of making a genuine effort to seek a win/win solution and trying to resolve the dispute in good faith through negotiation and discussion. Mediation

If the dispute cannot be resolved through negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking mediation online or by telephone if we are not both geographically located within 100 km of each other. The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional by the President of the Law Society of Victoria or a similar neutral authority. We agree to share all the costs of mediation equally between us. We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation has been exhausted.

Non-Disparagement

If a dispute arises, we all agree that we will not engage in any public discussion about the issues. We will behave politely towards each other, and we will avoid any conduct or communication that might reasonably be expected to unreasonably interfere with any other person's business or personal interests.

Jurisdiction

This agreement is subject to the governing law of Victoria. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Victoria, and the Commonwealth of Australia, will have exclusive jurisdiction.
